Pakistan to change legal team fighting Jadhav's case at ICJ

In a provisional win for India, the International Court of Justice stayed the execution of Kulbhushan Jadhav, a retired Indian naval officer whom Pakistan arrested previous year and convicted of espionage.

Addressing reporters here, Congress spokesperson and former Union Minister Anand Sharma said the ICJ verdict must be respected by Pakistan saying Islamabad's argument before the court and its refusal to accept its jurisdiction betrays a mindset of disrespect to the Vienna Convention, which Pakistan has brazenly violated.

The handling of Kulbhsuhan Jadhav case by Pakistani lawyers in the International Court of Justice (ICJ) has invited heavy criticism from experts as well as media in the country.

It also noted the urgency of the case since Pakistan had given "no assurance that Mr Jadhav will not be executed before the court has rendered its final decision".

Some Pakistanis have now begun to ask questions about why Indian national Kulbhushan Jadhav was denied consular access.

Kulbhushan Jadhav, 47, was arrested in March 2016 in the Balochistan province of Pakistan.

Rejecting Pakistan's argument that the court did not have jurisdiction in the matter, the ICJ accepted Salve's reasoning that it could hear the case because it involved, on the face of it, a violation of one of the clauses of the Vienna Convention, which both Pakistan and India ascribe to.

The unanimous decision by ICJ is considered a victory for New Delhi over its bitter rival.

"Pakistan should not execute Jadhav pending final proceedings".

No date has yet been set for Mr Jadhav's execution, although Pakistan told the ICJ during the trial that it was unlikely to happen before August 2017.

The International Court of Justice (ICJ) on Thursday ordered Pakistan to stay the execution of Yadav convicted of spying. On April 10 this year, a Pakistani military court sentenced him to death.

Jadhav reportedly joined India's prestigious National Defence Academy in 1987 and was commissioned as an engineer in the Indian Navy in 1991. "The United Nations should also take a serious note of it".

With just a day to go for the expiry of a 40-day deadline to challenge the death sentence given to Kulbhushan Jadhav, Indian officials said on Friday they do not know if Pakistani military authorities are even considering an appeal submitted by the former Indian navy officer's mother.

"We are very happy with the world court's verdict in Kulbhushan Jadhav's case".

"The entire nation is very happy about the interim direction given by the International Court of Justice and I congratulate the entire team of MEA, including our Prime Minister and Foreign Minister".
