On run, Justice CS Karnan retires

In May 2017, Justice Karnan was sentenced for imprisonment for repeated incidents of contempt of court.

In a first of many, Justice CS Karnan on Monday is all set to will miss the official farewell speech and become the first judge in the history of the Indian High Court to retire while still at large.

Justice Karnan had left Kolkata on May 9 itself and remained elusive thereafter even though Director General of West Bengal Police constituted teams of police personnel which went to Chennai and other places looking for him.

The Supreme Court bench comprising Justices Dipak Misra, J Chelameswar, Ranjan Gogoi, M B Lokur, P C Ghose and Kurian Joseph prohibited media from publishing any orders passed by Justice Karnan.

Justice Karnan, who turned 62 on Monday, hails from a village in Cuddalore district of Tamil Nadu.

In order to execute the Supreme Court directive, a team of the West Bengal police led by a director-general of police-rank officer has been camping in Chennai since May 10, but in vain.

Coincidentally, May 9 was also the last working day for the Supreme Court before it closed for the one-and-a-half month long summer vacation.

If he is arrested in the next few days, he will have the only consolation of not being arrested in office and the ignominy of a sitting judge sent to jail.

Probably the police may lay its hands on the controversial judge now that he has retired.

The Calcutta High Court judge was earlier suspended from duty by the apex court on charges of contempt of court. In response to this letter, the SC initiated proceedings for a contempt case against the judge on February 8. As on date, the apex court's order of arrest of Justice Karnan, therefore, remains unexecuted.

He was transferred from the Madras High Court for his repeated allegations and run-ins with its then chief justice and fellow judges.
