Aadhaar-PAN Linking Mandatory From July 1, Centre Notifies Rules

The Central Government on Wednesday made it mandatory quoting of Aadhaar number or enrolment ID to apply for PAN.

All tax payers who have been allotted Permanent Account Number (PAN) need to intimate their Aadhaar number to the income tax authorities for the objective of linking both the numbers, according to the notification dated June 27. So, the government has made it mandatory to link the 12-digit unique identification number Aadhar with your PAN (Permanent Account Number) as the linking of Aadhar with PAN can eliminate fake or multiple PAN's held by the same person from the system.

There are over 25 crore PAN card holders in the country while Aadhaar has been issued to 111 crore people.

Meanwhile, PAN card has ten digits alphanumeric number allotted bu I-T department to individuals and entities.

Earlier this month, the tax department had clarified that the relief granted by the Supreme Court regarding non-cancellation of PAN for not linking Aadhaar with it was applicable only in cases of people who do not have Aadhaar and do not wish to obtain it for the time being.

The rule will come into effect from July 1, reports PTI.

The bench said that previous transactions won't be affected or nullified with partial stay on the new law till privacy issue linked to Aadhaar is decided.

The bench rejected the contention that since the apex court has been passing orders time and again on the issue of Aadhaar, government should not have come out with a provision in the IT law to make UIDAI mandatory for the objective of allotment of PAN and linking it with the ITR.

If Aadhaar number is not allotted, then the enrolment ID of Aadhaar application form needs to be given, the notification said. Now aadhaar number is mandatory to get a new PAN number from July 1.

However, Attorney General Mukul Rohatgi had contended that Aadhaar was made mandatory for allotment of PAN to weed out fake cards which were used for terror financing and circulation of black money. Recently, the provisions of the IT Act were upheld by the High Court, although it was banned until the judgment was passed by the Constitution Bench of the High Court.
