J&K braces for unrest over Article 35A

Though the case has been going on since 2014, what has caused panic is the recent reply by the Centre to the court.

Asked whether the Peoples Democratic Party will pull out of the alliance if the Article 35 A is scrapped, the party leader said: "What option will we have!", he said.

As per the constitution of Jammu & Kashmir adopted in 1956; Permanent Residents are 'All persons born or settled within the state before 1911 or after having lawfully acquired immovable property in the state for not less than 10 years prior to that date.

'This issue can have wider ramifications.

"The trick that the RSS wants to play by asking the Supreme Court of India to revoke Article-35 A, has the potential of creating commotion in the country, especially in Jammu and Kashmir State", he added.

Abdullah after chairing the meeting of opposition parties on Monday called for devising a strategy how to counter any move to stop tinkering with Article 35 (A). A petition was filed by Delhi-based NGO We the Citizens demanding that Article 35A be repealed because of its "unconstitutional" character.

The top court's decision comes at a time when a debate on Article 35A of the Indian Constitution, which is interlinked with Article 370, is brewing as there have been legal challenges involving that Article as well. 'Mehbooba called on @JKNC_ President this evening to discuss the prevailing political situation in the state. "I have no doubt in saying that there will be no one to hold it (if the article is diluted)", Mehbooba said in Delhi at the end of July.

A Bench of Chief Justice of India J.S. Khehar, Justices A.K. Goel and D.Y. Chandrachud issued notice to the Centre on the petition filed by Vijayalakshmi Jha pointing out that Article 370 was a "temporary provision". They say tinkering with the the Articles would be end of the road for pro-India mainstream parties and pro-India constituencies in restive Jammu and Kashmir.

Former J&K Chief Minister Omar Abdullah, who was present when Mehbooba Mufti dropped at the residence of her bitter rival and NC President Farooq Abdullah to discuss Article 35 (A) on Tuesday, also lambasted the CM for sharing power with the BJP despite "opposing their politics".

Both these articles, instead of being beneficial to the people of the state, have done great damage and hampered progress and development, said state BJP spokesperson Virender Gupta.
