Hearing on Ezekiel Elliott's suspension set for next month

On Friday, the U.S. Fifth Circuit Court of Appeals has set a date of Monday, Oct 2 at 1 p.m. CST to overturn a preliminary injunction which was handed down by District Court judge Amos Mazzant.

The session is scheduled for noon Central time October 2 in New Orleans.

Mazzant granted Elliott's request for an injunction that blocked the NFL's suspension based on fundamental unfairness of the arbitration process and irreparable harm to Elliott.

The NFL asked the 5th Circuit to rule by September 19 or September 26.

He led them last season with 22.4 points per game even while dealing with the constant distraction of trade talks. Phil Jackson made it known he was trying to trade Anthony before he was ousted as the team's president in June.

That previous ruling allows Elliott to play in games while the legal system decides whether or not the league acted within the confines of the CBA in handing down punishment to the Cowboys running back over his domestic violence investigation.

Dallas Cowboys running Ezekiel Elliott is still clear to play Monday against the Arizona Cardinals.

The league's primary argument arises from the fact that Elliott filed his lawsuit before arbitrator Harold Henderson issued a ruling on the appeal of the suspension, making the entire case premature and preventing the Texas federal court in which the lawsuit was filed from acquiring proper jurisdiction over the dispute.

With the 19th passed, the National Football League had hoped for a ruling by today in advance of this weekend's games and barring a last-minute ruling by Sunday. Elliott rushed for a career-low 8 yards on nine carries. "We anticipate Zeke practicing today, we anticipate him playing in the ballgame. We're going to control what we can control until someone tells us otherwise".
