Judge in Menendez Bribery Trial Urges Jury to Push Through Deadlock

Robert Menendez (N.J.) told the jury on Monday to continue deliberating after the jurors said they are deadlocked on whether to convict the senator.

The jury in the bribery trial of Democratic U.S. Sen. Bob McDonnell. That ruling played a significant role in how the jury was instructed in the Menendez trial.

"Go home, get a breath of fresh air or rain, or whatever it may be doing out there", U.S. District Judge William H. Walls said.

After jurors went to deliberate, Walls and Menendez attorney Abbe Lowell continued a running war of words over how the judge should conduct the trial.

That prompted Walls to interview the affected jurors one by one in his chambers. The deliberations were supposed to start from scratch once the alternate juror was seated, but instead, the jury seemed to zoom back into the logjam described by Arroyo-Maultsby.

"You are now a new jury", Walls said.

While her comments pierced the veil of secrecy shrouding all jury deliberations, they are unlikely to lead to a mistrial, Weinstein and other former federal prosecutors said.

"As I said two and a half years ago when I first faced these charges, I was innocent", he said.

Defense attorneys argued on Monday that excused juror Evelyn Arroyo-Maultsby's comments that she was told she couldn't send the judge a note last week could represent a breach of protocol.

An acquittal would reinforce the view that official bribery cases have become more hard to prosecute, a trend traced to last year's U.S. Supreme Court ruling that overturned the bribery conviction of former Republican Virginia Gov.

"It is your duty as jurors to consult with one another", he said. Walls repeatedly instructed them throughout the trial not to discuss the case with anyone outside the courtroom until a verdict had been reached.

Another of Arroyo-Maultsby's comments could also be significant, said former federal prosecutor Michael Weinstein, now the head of white collar defense and investigations for the Cole Schotz law firm.

"The feedback from the one juror who has spoken out was pretty powerful", Lurie said. "It seems particularly hard on these facts so far". Bob Menendez's bribery trial suggest the panel could wind up deadlocked or voting for acquittal, because many of them may believe the defense's central argument in the case. On Monday, an alternate was brought in to replace her.

Menendez is charged with accepting gifts from a wealthy Florida eye doctor in exchange for using his political influence.

Menendez has vigorously denied the charges, saying that he will be vindicated at trial and run for re-election next year. He is also charged with making false statements for not reporting the gifts on Senate disclosure forms.
