Judge Denies Cosby Defense Request For Mistrial

Lise-Lotte Lublin told jurors she lost consciousness and doesn't remember anything else about that night in 1989 - a time when Cosby was at the height of his fame starring as sweater-wearing father-of-five Dr. Cliff Huxtable on America's top-rated TV show, "The Cosby Show".

Over dinner he allegedly handed her a blue pill she thought would ease menstrual cramps, but which left her feeling "out of it" before Cosby raped her, leaving her "humiliated". His lawyers have portrayed Constand as a gold-digging con artist.

On day four of Cosby's retrial, the prosecution wrapped testimony from five other accusers - in addition to Constand - allowed to give evidence in what experts say presents a gargantuan hurdle for the defence. He says the encounter was consensual.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.

Bill Cosby and spokesperson Andrew Wyatt, break for lunch during the Cosby sexual assault retrial case at the Montgomery County Courthouse in Norristown, Pennsylvania, U.S., April 13, 2018.

In her testimony Friday, Constand denied ever having intimate contact with Cosby prior to the alleged assault at his home.

After telling her guidance counselor and sister, she says she later received a chilling call, she testified, from Cosby himself.

Turning to Cosby, she made the remark that suggested he remembered the encounter.

Unlike in the first trial, jurors in this case were told Cosby agreed to the $3.4 million settlement in 2006. The retrial this week was actually the first time the settlement and sum was officially made public, and the defense has gleefully been using it to try and discredit Constand as being "greedy" and a "gold digger", as defense attorney Tom Mesereau claimed in opening statements.

Six feet tall, wiry and with a mane of curly hair, Constand spoke stiffly at first but warmed considerably when asked about her interests, in the fields of natural medicine and homeopathy.

Constand's much-anticipated testimony follows several harrowing days of powerful accounts from four other accusers, all of whom paint "America's Dad" as a calculating sexual predator.

A year after the first trial, a confident Constand walked into the courtroom and faced questions from both the prosecution and defense through the morning.

If Constand wasn't interested in Cosby's advances, Mesereau said, "Why do you keep going back and back and back and back?"

Women who say comedian Bill Cosby knocked them out with intoxicants and sexually assaulted them decades ago are finally getting a chance to confront him - and they aren't holding back.

Andrea Constand took the stand at his sexual assault retrial Friday.

Dickinson testified she got to know Cosby after he called her agent and said he wanted to meet and possibly mentor her as she looked to expand her career into singing and acting. Thomas admitted she sent the message and wanted to help Constand.

All of them testified they wound up unconscious from the pills or alcohol Cosby gave them, unable to say no or resist as he had his way with them. She says she awoke to find Cosby penetrating her with his fingers and putting her hand on his penis. The combination immobilized her and rendered her unable to speak.

But on Tuesday, during a blunt and bruising opening statement, Cosby's lead defense attorney, Thomas Mesereau, made clear that he would seek to make the entertainer's accuser, Andrea Constand, the real focus of the trial.

Security was stepped up on Tuesday outside of the courthouse in suburban Philadelphia after a topless protester jumped over a barricade on Monday and ran toward Cosby. In June, a judge declared a mistrial when the jury in the first trial could not reach a verdict.

The defense has called the other accusers irrelevant, urging jurors to focus only on the charges that Cosby is facing.

"I couldn't fight him off", testified Andrea Constand, then operations manager for the women's basketball team at Temple University and now a massage therapist living in Canada.

Dickinson testified she cut out the story of being sexually assaulted by Cosby after her publisher warned her it could ruin her career. The 80-year-old comedian is charged with drugging and molesting a woman in 2004.
