BJP MLA of Unnao in rape net

Unnao rape case: On Thursday, police lodged an FIR against Kuldeep Singh Sengar in connection with the alleged rape after the state government made a decision to hand over the probe to the CBI.

A notification was issued by the Personnel Ministry on Thursday night following a request for a CBI probe by the Uttar Pradesh government, an official said.

Sengar's lawyer said, "We support fair investigation. Once we procure substantial evidence, we will go ahead with the arrest of the MLA and his henchmen", disclosed a senior CBI officer engaged with the investigation.

After a massive public outrage over the inaction of the UP police, the case was handed over to the CBI on April 12. A case has been registered against Kuldeep Singh Sengar but he has not been arrested. The team sought for the phone records of Sengar and his brother Atul, who was earlier arrested for allegedly killing the victim's father who was in police custody.

The Central Bureau of Investigation (CBI) detained Sengar on Friday morning and confirmed his arrest later in the day.

On the opposition parties accusing the UP government for "delaying the MLA's arrest", Singh referred to the former chief minister Akhilesh Yadav having "shielded rape accused minister" Gayatri Prajapati.

Uttar Pradesh Chief Minister Yogi Adityanath had agreed to transfer the case to the CBI this week in face of mounting pressure to crack down on the powerful Unnao MLA.

This comes a day after a senior BJP leader in Uttar Pradesh claimed that the Chief Minister had chose to arrest the accused MLA but his decision was changed after the intervention of a "prominent person".

Rape victim's uncle alleged that his brother was being forced to take the case back and when he refused, false cases were lodged against him.

The matter caught attention of media when the girl tried to immolate herself in front of the Chief Minister's residence last week. He also said that the family still fears for their life but were hopeful that no harm would come to them as the premier investigative agency had now taken up the case.

According to the rules, the CBI re-registers the FIRs filed by a state police when taking over a probe, but remains at freedom to arrive at its own conclusions, which are filed before a special court in its final report.

A day after the girl's attempted suicide near CM Yogi Adityanath's house on Sunday, her father died in police custody in Unnao on Monday.
