Defense claims Cosby wasn't around for assault

Russell met Constand when both lived in Canada in 2000 and described himself as having been "more than a close friend" to the woman who could put Cosby in prison for the rest of his life.

Cosby paid Constand $3.38 million to settle a civil lawsuit she filed after Pennsylvania prosecutors in 2005 initially declined to charge Cosby for the alleged assault.

Judge Steven O'Neill said in court Thursday there are only a few more days of testimony in the case that pits Cosby against a woman who says he drugged and molested her at his home outside Philadelphia.

The mysterious blue pill Cosby gave his allegedly gave Andrea Constand at his home has remained a subject of controversy throughout the case.

The defense also called Robert Russell, a 57-year-old motor coach operator from Montreal, to testify about Constand's desire to become a sports broadcaster.

As previously reported, Constand claims that Cosby drugged and molested her inside his Cheltenham, Pa., estate in January 2004.

Judge O'Neill also said he'd rule Monday on whether the defense can read into the jury statements by Sheri Williams, a buddy of Ms. Constand'therefore, at a residue given during Ms. Constand's 2005 civil lawsuit against Mr. Cosby.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.

Cosby said in a subsequent police interview that he gave her Benadryl, then fondled her breasts and genitals.

At the first trial a year ago, which ended at a mistrial after the jury had been deadlocked, Ms. Constand experienced sentenced being in touch Ms. Williams throughout the span she claimed she had been attacked by Mr. Cosby.

Durant, however, walked off under his own power and told reporters that he was fine after the game. The two-time MVP will be evaluated Friday but "isn't in the final stages of his rehabilitation".

Constand testified at Cosby's first trial previous year that she and Williams were good friends and would speak "at all hours of the day: morning, noon, and night". But Dr. Milman's knowledge of the forensic side of toxicology seemed only tangential, as he at one point cited a Viagra-using perpetrator as an instance of "drug-induced sexual assault". Cosby says he gave her Benadryl to help her relax and that she consented to a sexual encounter.

In a transcript read to the jury Wednesday, the "Cosby Show" star said he obtained seven prescriptions for quaaludes from his doctor in Los Angeles in the 1970s, ostensibly for a sore back, but added he didn't use them himself because they made him exhausted.

Alcohol would only enhance each pill's sedative effects, Rohrig said, leading to impaired vision, "mental clouding", dulled senses, short-term memory impact, and would engineer muscle weakness and clumsiness.

"Quaaludes happen to be the drug that kids, young people were using to party with, and there were times when I wanted to have them just in case", Cosby testified, according to the transcript.

The judge in Bill Cosby's sexual assault retrial is rejecting the defense's fifth bid for a mistrial.

O'Neill said there were "simply no grounds for a mistrial" and that Cosby's lawyers were raising the issue too late.

Testimony wrapped up early on Day 10 of Cosby's retrial. Meister and Harjo testified about portions of Cosby's flight and travel schedules from late 2003 and early 2004. He says it was consensual.

The 80-year-old comedian arrived at a suburban Philadelphia courthouse Thursday morning where the jury is expected to hear from a pair of drug experts.

Bill Cosby's lawyers have turned to their star witness in the comedian's sexual assault retrial. Jackson, a Temple University academic advisor, who worked with Andrea Constand, testified that Constand said she could make up a story that a celebrity sexually assaulted her to gain a large cash settlement.

The jury is expected to hear from a pair of drug experts on Thursday.
