The Indian prime minister Narendra Modi's party has snatched a fragile victory in a state election outside its political heartland, boosting momentum for the Hindu nationalist leader a year before national polls.

The Bharatiya Janata Party gained Karnataka after a series of twists and turns and a rare pre-dawn court intervention, setting the stage for behind-the-scenes political maneuvering to prove its majority.

To avoid poaching, JD (S)-Congress are moving all their MLAs out of Karnataka- probably to Cochin, reports suggest.

"Calling a person who has support of 104 MLAs as opposed to Congress-JDS alliance of 116 MLAs and then giving the person 15 days is adding insult to injury by the governor", argued senior advocate Abhishek Manu Singhvi. Before Chief Minister Yeddyurappa's swearing-in at 9 am on Thursday, the Supreme Court opened its doors at 1.45 am to hear the Congress-JD (S) petition.

It has been revealed that this application will be heard along with the main petition challenging the Governor's decision to invite Yeddyurappa to form the government.

The BJP's emphasis on economic development fused with appeals to Hindu nationalism has won it several states across western and northern India but has had less appeal in the south.

Yeddyurappa to form a new government in the state despite being eight short of a simple majority in the assembly. Chandy is member of the NCP, which is coalition partner in the ruling Left front in the state. But the governor instead asked Modi's party to try and prove its majority.

This irked Congress which moved to Supreme Court against Karnataka Governor Vajubhai Valla's order. It is due to sit again on Friday morning. A murder accused is a president of a national party today.

The BJP won 104, the Congress 78 and the JD-S 37.

"For the BJP, while an outright win would have been ideal, the current numbers are still a positive and critical indicator of their standing", Kumar said.

"For the first time in the last 70 years, four judges went to the public saying that they are being pressurised and threatened".

In Bengaluru, the capital of Karnataka state, BJP supporters were seen rallying outside the party's headquarters, holding up flags and chanting slogans as the results rolled in.

"Its well-defined party structure, with clear authority lines and highly motivated members, sits in stark contrast to the Congress, which is still plagued by an inability to restructure and re-organize itself in a substantial manner under party president Rahul Gandhi", Rao said.
