Harvey Weinstein: Part of sexual assault case against Hollywood producer dropped

Weinstein, an worldwide pariah after being accused by more than 80 women of sexual misconduct, is still charged with rape in March 2013 and a forced act of oral sex in 2006, which could see him spend the rest of his life in prison if convicted.

The judge said the case involving then-actress Lucia Evans was dismissed. this after prosecutors jumped the gun and asked the judge to 86 the charge of sexual assault.

Harvey Weinstein appeared without handcuffs in New York Supreme Court this morning and even flashed a faint smile, a big change from his previous sober and shackled appearances in his sexual assault trial.

The defense says the emails do not reflect communications between a rapist and a victim, including one in which she wrote, "Your the one who makes it look good with your smile and handsome eyes".

A letter dated September 12 that reportedly describes the Evans-Weinstein encounter as consensual will be unsealed later today by the court. Evans has denied the account, according to a D.A.'s letter, asserting that she never exposed her breasts to Weinstein or gave him oral sex.

Brafman accused Evans of perjury, stating that she once described her encounter with Weinstein as consensual to a witness, who recounted the story to NYPD previous year.

A letter previously filed under a protective order was unsealed on Thursday, which not only revealed credibility issues with one of Harvey Weinstein accusers, but also possible misconduct by a NY detective.

During the Thursday hearing, the prosecutors agreed to drop charges relating to an alleged sexual assault.

"In short, your honor, we are moving full steam ahead", she said.

Mr. Weinstein was arrested in late may in NY, eight months after the publication of the first accusations of sexual harassment, sexual assault and rape aimed.

An attorney for Evans told the Associated Press the dropping of the count "says nothing about Weinstein's guilt or innocence". "It only speaks volumes about the Manhattan DA's office and its mishandling of my client's case".

Goldberg insisted Evans has told the truth and disputed that she either showed Weinstein her breasts or misled investigators.

Weinstein defense attorney Benjamin Brafman accused Evans of committing perjury when she testified to the grand jury.

'The integrity of these proceedings has been compromised, ' he said. However, an email from Evans from 2015 suggests that the interaction was consensual.

"I think this grand jury is irreparably damaged".

"Sexual assault is a serious crime but falsely accusing someone of sexual assault is also a serious crime", Brafman said outside court on Thursday.

Brafman identified the detective in the case as Nicholas DiGaudio.

A message left on a phone DiGaudio used in the past wasn't returned.

There was no immediate response from the New York Police Department. He pleaded not guilty and was released on $1 million bail.

Weinstein has been accused of misconduct by dozens of women, allegations that torpedoed his career and helped launch the #MeToo movement. In May, she became one of eventually three women to form the foundation of the criminal case against him.
