Judge Dismisses Stormy Daniels' Defamation Lawsuit Against Donald Trump

On Monday, a federal district court judge in California ruled to dismiss Stormy Daniels' defamation lawsuit against President Donald Trump, and ordered the adult film star to pay his legal fees.

After Ms Daniels's lawyer released a sketch of a man who allegedly told her to remain silent in 2011, Mr Trump, who denies having an affair with Ms Daniels, tweeted it was a "total con job" about a "nonexistent man". "The First Amendment protects this kind of rhetorical statement", the judge wrote in his verdict.

Charles Harder, Trump's lawyer, said the amount of the award for Trump's attorneys' fees would be determined later.

Mr Cohen paid Ms Daniels $130,000 in "hush-money", but claimed he paid this out of his own funds and Trump has no knowledge of the exchange.

In a statement of his own, Avenatti took issue with the characterization of his client's loss in this case as a "total defeat" for her and a "total victory" for Trump, given that this was only one of the cases that Daniels had brought against Trump, with the main case still in play.

The ruling is a blow for Daniels and her lawyer, Michael Avenatti, who has raised a national profile from his legal battles against the president and is contemplating a presidential bid in 2020.

"We will appeal the dismissal of the defamation cause of action and are confident in a reversal", Avenatti vowed.

Donald Trump's tweets can sometimes move markets, antagonize domestic rivals and worldwide allies and put the spotlight on friends and foes but turns out today that the social media platform cannot keep the President in court with Stormy Daniels.

Daniels originally sued Trump and Cohen, who negotiated the deal, so she could speak publicly about the reported tryst without fear of reprisal.

President Donald Trump has scored his first major legal victory against adult film actress Stormy Daniels. Cohen said he was directed to carry out the crime by the president himself during the 2016 campaign.

In the lawsuit, Clifford alleged that a Trump tweet, which said she had fabricated the encounter, had defamed her, saying it made her out to be a liar.
